UK road traffic victims lack awareness of compensation rights

Reports indicate that many road traffic collision victims in the UK are unaware of their rights to seek compensation. A study by the Office of the Victims’ Commissioner found that victims are frequently not informed about potential compensation or the necessity of instructing a solicitor, particularly in cases involving serious injury or death.

Victims reported that the civil claim process is often lengthy, expensive, and stressful, requiring significant paperwork and the revisiting of trauma. Some individuals settled for lower sums with insurance companies prematurely due to the high costs associated with legal fees and the desire to move on.

Further research by law firm Irwin Mitchell highlighted a significant knowledge gap regarding legal reforms and deadlines. Two-thirds of drivers surveyed were unaware of the 2021 whiplash reforms, and 59% had no knowledge of the three-year limitation period for personal injury claims. The study also noted that many drivers are unaware they can claim for psychological injuries, such as post-traumatic stress disorder or severe driving anxiety.
