United States immigration authority and potential Muslim ban

Attorney Will Chamberlain has suggested that the United States may have the legal authority to restrict immigration from Muslim-majority countries. In a discussion with Elizabeth Farah, Chamberlain argued that the federal government possesses broad authority over foreign nationals seeking entry, as they do not hold the same constitutional protections as American citizens.

Chamberlain described a policy of “net negative Muslim migration” as a possible legal position, noting that the primary legal distinction lies at the border. He argued that preventing entry is legally simpler than attempting to regulate individuals once they have already entered the country and are protected by constitutional guarantees regarding religion, speech, and association.
