United States tightens immigration scrutiny for skilled professionals
Recent changes in United States immigration policy have increased the rigor of visa analysis and documentation requirements. The U.S. Department of Homeland Security (DHS) has proposed a fee of $103,265 for certain H-1B petitions subject to annual limits, though this measure is still in the regulatory process and does not apply universally to all requests.
Despite stricter scrutiny regarding candidate history and documentation, opportunities remain for highly qualified professionals. Other employment-based categories, such as EB-1, EB-2, and EB-3, offer different pathways. Specifically, the EB-2 category includes the National Interest Waiver (NIW) for professionals meeting specific criteria. Experts emphasize that the current landscape necessitates more meticulous planning and a clear understanding of which migratory category best aligns with an individual's professional profile to navigate the increasing regulatory demands.
