University of Maryland disputes trademark with Terps USA

The University of Maryland has issued a cease-and-desist letter to Terps USA, a Colorado-based cannabis company, demanding it stop using the name and logo. The university claims its ‘TERPS’ marks are valuable assets representing significant goodwill and expresses concern that consumers might believe the university endorses or sponsors the products.

Ken Fry, owner of Terps USA, stated he has operated under the name since 2019 and intends to keep it. Fry explained that ‘Terps’ is short for terpenes, which are chemical compounds used to enhance the flavor and aroma of cannabis. While he expressed a willingness to discuss changes to the company logo, he has refused to abandon the business name or its federal trademark.

Legal representatives for Terps USA have responded to the university, noting that the university’s federal registration for the word had previously lapsed. The university has requested changes within 30 days, stating that litigation counsel is prepared to take remedial action if the matter is not resolved.
