University of Texas at Dallas student sues over free speech violations

Gregorio Olivares Gutierrez, the former editor-in-chief of the student newspaper The Mercury, has filed a lawsuit against the University of Texas at Dallas (UTD) alleging violations of his First Amendment rights.

The legal action follows a two-year deferred suspension imposed by the university administration. The suspension was triggered after Gutierrez added a disclaimer to a letter submitted by the president of UT Dallas Hillel regarding campus antisemitism and the Israel-Palestine conflict. Gutierrez stated the disclaimer was necessary because the letter did not meet the publication’s journalistic standards. The university subsequently investigated Gutierrez for “discriminatory harassment” following a complaint from the letter's author.

Gutierrez claims the administration is weaponizing university policy to silence critical reporting. The lawsuit arrives amid broader concerns regarding free speech on Texas campuses; recent rankings from the Foundation for Individual Rights and Expression (FIRE) gave Texas universities an average grade of F, citing numerous controversies and high rates of student self-censorship.
