Unrelated legal rulings in Italy

The Italian Court of Cassation has declared Carmine Iovine’s appeal inadmissible, upholding a Naples Court of Appeal sentence for fraudulent bankruptcy involving both patrimonial and documentary offenses. The Supreme Court rejected arguments regarding the statute of limitations, noting that based on recognized aggravating factors, the 18-year and 9-month prescription period would not expire until June 25, 2027. The case involved the diversion of vehicles and funds.

Separately, the Court of Agrigento has suspended the enforcement of a €5.4 million payment order against the water utility company Aica (Voltano S.p.A.). The court granted a precautionary suspension to prevent the forced execution from compromising the company’s economic stability and the regular provision of integrated water services. Aica continues to contest the obligation, arguing the liability belongs to a different entity.
