UOKiK charges Google with abusing dominant position in Poland

The Polish Office of Competition and Consumer Protection (UOKiK) has initiated proceedings against four companies within the Google group: Alphabet Inc, Google LLC, Google Ireland Limited, and Google Poland. The regulator alleges that Google is abusing its dominant market position regarding Polish media publishers.

The investigation centers on Google's failure to sign agreements with most Polish press publishers to regulate the use of their content and ensure appropriate remuneration. This obligation is mandated by the European Union's Digital Single Market (DSM) copyright directive. UOKiK also expressed concerns regarding the methods Google used during negotiations with publisher organizations.

If the allegations are proven, Google could face fines of up to 10 percent of its annual turnover, which would amount to billions of zlotys. UOKiK President Tomasz Chróstny stated that 'Big techy cannot place themselves above the law,' emphasizing that regulations require Google to provide publishers with necessary information to ensure fair compensation for the content used in search results and other services.
