U.S. Attorneys General Sue to Block Trump ACA Rule

A coalition of state attorneys general, including Washington Attorney General Nick Brown and Delaware Attorney General Kathy Jennings, together with the governor of Pennsylvania, filed a lawsuit in the U.S. District Court for the Northern District of California. The suit challenges the Trump administration’s 2027 Notice of Benefit and Payment Parameters issued by the Department of Health and Human Services (HHS) and the Centers for Medicare & Medicaid Services (CMS). The rule would expand eligibility for catastrophic health plans that cannot receive premium tax credits, allow higher out‑of‑pocket costs, and reinstate provisions previously deemed unlawful. The plaintiffs argue the changes would raise costs, reduce enrollment, and shift financial burdens onto consumers, states and providers, undermining the Affordable Care Act. Brown said, “Washingtonians deserve high‑quality, affordable health insurance,” while Jennings called the rule “outrageous and cruel.”
