US CLARITY Act and EU MiCA Drive Global Crypto Regulation Overhaul
The Digital Asset Market CLARITY Act, which has cleared the U.S. House and is in final Senate negotiations, aims to assign oversight of crypto assets between the SEC (investment contracts) and the CFTC (digital commodities). It includes safe‑harbor provisions for DeFi and seeks to close AML/CFT gaps that leave many digital‑asset service providers unregulated. Lawmakers are pushing to finalize the bill before the August recess, with bipartisan support but a tight Senate vote threshold.
In the European Union, the Markets in Crypto‑Assets Regulation (MiCA) entered full effect on July 1, 2026, ending a transition period that required crypto‑service providers to obtain a Crypto‑Asset Service Provider (CASP) license. Analysis shows only about 17 % of the roughly 1,200 firms previously operating under national regimes have secured authorization, and regulators estimate that 75‑83 % may be forced to exit the market. The deadline affects exchanges, custodians, brokers and stablecoin issuers, with compliant tokens such as USDC and EURC remaining viable while Tether (USDT) faces de‑listing in EU venues. The licensing pressure also weighs on Binance’s BNB price, as the exchange’s MiCA application encounters resistance from EU authorities.
These regulatory developments, alongside the U.S. GENIUS Act for stablecoins, are reshaping the crypto sector worldwide, compelling firms to adapt compliance frameworks or risk losing access to major markets.
