Fifth Circuit Court rules immigrants have no constitutional right to bond hearings
The U.S. Fifth Circuit Court of Appeals ruled in an en banc 10-7 decision that certain immigrants detained by Immigration and Customs Enforcement (ICE) do not have a constitutional right to individual bond hearings while facing deportation proceedings. The ruling, issued in the case Sosnava Rodriguez v. Ortega, applies to immigrants who entered the U.S. without inspection under Section 1225(b)(2)(A).
The decision reverses several lower court rulings that had ordered the release of detainees or required bond hearings to assess flight risk and dangerousness. The court held that because these individuals were never legally admitted to the country, they are only entitled to the due process protections specifically provided by Congress, rather than broader Fifth Amendment guarantees regarding liberty interests.
The ruling has immediate implications for the states within the Fifth Circuit's jurisdiction: Texas, Louisiana, and Mississippi. It strengthens the Trump administration's ability to maintain mandatory detention policies as part of its broader deportation agenda. While the decision does not establish a nationwide rule, it limits the ability of federal district judges in these states to use due process arguments to secure the release of detainees.
