US Democratic lawmakers demand reversal of USCIS green‑card policy shift

Congressional Democrats led by Senators Alex Padilla and Dick Durbin and Representatives Jamie Raskin and Pramila Jayapal sent a letter to USCIS Director Joseph Edlow objecting to a May 21 policy memorandum that recharacterizes adjustment of status as an “extraordinary form of relief.” The memo introduces new discretionary standards, a preference for consular processing abroad, and an undefined “national interest” or “economic benefit” test that the lawmakers say are not authorized by the Immigration and Nationality Act.

The Democrats argue the guidance undermines longstanding precedent, threatens family unity, and could disrupt skilled workers, entrepreneurs, researchers, medical professionals and businesses that rely on foreign talent. They request answers to nine specific questions about the policy’s effective date, covered applicants, and implementation, and they urge USCIS to restore the traditional adjustment‑of‑status process within the United States.
