U.S. Department of Justice expands immigration reporting mandates for states
The U.S. Department of Justice has issued a new legal opinion that significantly expands immigration reporting requirements for state governments. Under this interpretation, any state participating in federal welfare programs, specifically Temporary Assistance for Needy Families (TANF) and Supplemental Security Income (SSI), must ensure that all its agencies report known undocumented individuals to the Department of Homeland Security (DHS).
This decision reverses a 1998 interpretation that limited these reporting duties to only the specific agencies administering the welfare benefits. The new mandate extends to all state government entities, including motor vehicle departments and state universities. The Department of Justice maintains that this change restores the original intent of the 1996 Personal Responsibility and Work Opportunity Reconciliation Act.
Compliance is tied to federal funding; states that fail to meet these reporting obligations risk losing billions of dollars in federal assistance. The policy applies prospectively and does not penalize past decisions made under the previous 1998 guidance. The move has already faced legal challenges from several states and is expected to be contested in court.
