U.S. Department of Justice sues Kansas school districts over gender identity policies

The U.S. Department of Justice has filed a lawsuit against Kansas City, Kansas Public Schools to prevent the district from facilitating gender transitions for students without parental knowledge or consent. The legal action alleges violations of the Family Educational Rights and Privacy Act (FERPA) and the Protection of Pupil Rights Amendment (PPRA).

Investigations into the district included recordings where staff discussed maintaining transgender guidelines that were not available to the public. The DOJ's Civil Rights Division stated that parental rights are paramount and that the department will not tolerate districts bypassing federal law regarding gender identity.

In a related development, the U.S. Department of Education has entered into a Resolution Agreement with Topeka Public Schools following investigations into policies that hid students' gender identities from parents. While Topeka has agreed to the terms, Olathe Public Schools and Shawnee Mission Public Schools have not, leaving them subject to potential judicial proceedings and the loss of federal funding.
