US DOJ and HHS launch healthcare fraud self-disclosure pilot

The US Department of Justice (DOJ) and the Department of Health and Human Services (HHS) have introduced a six-month pilot program aimed at encouraging healthcare organizations to voluntarily disclose potential False Claims Act (FCA) violations.

Administered through the DOJ Civil Division, the Healthcare False Claims Act Self-Disclosure Pilot Program (FCA SDPP) allows eligible entities—including providers, suppliers, manufacturers, and payers receiving federal funds—to report previously undisclosed misconduct. Under the framework, participating organizations may resolve violations through financial repayment, estimated at 1.25 to 1.6 times the base amount, in exchange for specific civil liability protections and a structured approach to corrective action.

Submissions for the program are being accepted through April 22, 2027. To participate, organizations must provide detailed descriptions of the unlawful conduct, identify relevant legal requirements, submit supporting documentation, and outline corrective measures taken to prevent future occurrences.
