U.S. DOJ joins Elon Musk in legal fight against EU's €120M X fine
The U.S. Department of Justice has requested to intervene in a legal battle involving Elon Musk and his social media platform, X, to help overturn a €120 million fine imposed by the European Union.
The fine, issued by the European Commission in December 2025, was the first penalty under the Digital Services Act (DSA) for alleged breaches of online content and transparency rules. The DOJ is supporting X Internet, X Holdings, and Musk in two cases before the General Court of the European Union in Luxembourg: T-114/26 and T-121/26.
Washington argues that the European Commission is engaging in regulatory overreach by attempting to expand its authority to American companies that do not operate within its jurisdiction. A central point of contention is the Commission's method of calculating the fine based on the worldwide annual turnover of the economic unit controlled by Musk. The DOJ, in coordination with the State Department, noted that the outcome could significantly impact U.S.-EU relations and the broader American technology sector.
