U.S. Fish and Wildlife Service Revises Endangered Species Act Rules for Threatened Species

On July 17, 2026 the U.S. Fish and Wildlife Service (FWS) issued final revisions to regulations implementing the Endangered Species Act (ESA). The rules eliminate the agency’s “blanket” Section 4(d) rule for newly listed or re‑classified threatened species, requiring FWS to develop species‑specific protections that are deemed “necessary and advisable.”

A second rule changes the process for excluding areas from critical‑habitat designations, requiring an economic analysis and a balancing of benefits before exclusion is allowed. Both rules take effect on August 20, 2026, restore provisions first adopted during the initial Trump administration that were later rescinded by the Biden administration, and follow a July 14, 2026 change that removed longstanding definitions of “harm.”
