U.S. Government seeks to dismiss lawsuit by 992 Cubans in Miami
The United States government has filed a motion to dismiss a lawsuit brought by 992 Cuban migrants in Miami who entered the country under I-220A documentation. In the case Bello-Rubio, the government argues that the court lacks jurisdiction and that the claims lack sufficient legal merit.
The plaintiffs are seeking to have their initial detention and subsequent release recognized as “parole.” Such a designation would potentially allow them to apply for permanent residency under the Cuban Adjustment Act, provided they meet other legal requirements. The legal battle continues after Judge Jacqueline Becerra previously rejected a government attempt to close the case in September.
In addition to the dismissal request, the government has responded to motions regarding protective judicial measures and the plaintiffs' request to certify the case as a class action. A class-action certification would allow a potential ruling to apply to other individuals in similar legal circumstances.
