Somalia TPS: Federal judge clears way for Trump administration to end protections
U.S. District Judge Allison Burroughs has lifted an administrative stay, clearing the way for the Trump administration to terminate Temporary Protected Status (TPS) for Somalia. The ruling allows the Department of Homeland Security to move forward with ending the program, which has provided humanitarian protection and work authorization to Somali nationals since 1991.
The decision affects approximately 1,100 Somali individuals who may now face deportation if they do not hold other lawful immigration status. While the judge acknowledged that plaintiffs made a “convincing showing” of potential irreparable harm and raised arguments regarding racial bias, she concluded they failed to demonstrate a likelihood of success on the merits of their case.
This legal development follows a June Supreme Court ruling in Mullin v. Doe, which significantly limited the ability of federal courts to review DHS decisions to terminate TPS designations. The administration, led by former Homeland Security Secretary Kristi Noem, argued that conditions in Somalia have improved sufficiently to justify ending the designation, despite ongoing conflict involving al-Shabaab militants.
