US Judge Blocks Trump Administration Visa Restrictions on Disinformation Researchers

Chief U.S. District Judge James Boasberg issued a preliminary injunction halting a State Department policy that denied visas and threatened deportation of foreign nationals who study disinformation and hate speech on social media. The policy, announced by Secretary of State Marco Rubio, was challenged by the Coalition for Independent Technology Research, which argued that it weaponized immigration law to suppress speech and research. Boasberg ruled that the policy likely violates the First Amendment by imposing viewpoint‑based discrimination on non‑citizen scholars.

The court noted that the visa bans had affected researchers, activists and even a Brazilian Supreme Court justice, creating a chilling effect on academic work. Coalition attorney Carrie DeCell said, “This policy punishes researchers for work the public needs and the First Amendment protects.” The decision blocks enforcement of the visa limits and marks a significant judicial rebuke of the administration’s attempt to use immigration as a tool for political enforcement in technology policy.
