US Justice Department seeks to revive prize courts to seize Iranian oil
The US Department of Justice is preparing to revive maritime “prize courts,” a legal mechanism that has been largely dormant since World War II. This initiative aims to expedite the military seizure of Iranian oil tankers and cargo, designating them as US property.
Under this plan, federal prosecutors could seize oil and other goods from enemy or even neutral vessels. The proceeds from the sale of these seized assets would then be transferred to the US Treasury. US Attorney Aaron Reitz, based in Houston, confirmed the department is reviving this “ancient body of maritime law” to strengthen the blockade against Iran and offset conflict-related costs.
The Southern District of Texas is being considered as a primary venue for these proceedings. While the move is intended to provide a faster alternative to civil forfeiture laws, it is expected to face significant legal challenges from ship owners and third parties.
