US legal and political challenges target Title IX and transgender school policies

Legal and political challenges regarding transgender rights and Title IX are intensifying in the United States. In North Carolina, the legal group America First Legal has requested a federal court to strike down a Cabarrus County School Board policy. The group is supporting a lawsuit filed by three female students who argue that allowing biological males to use girls’ bathrooms and locker rooms constitutes unlawful sex discrimination and violates the 14th Amendment.

Simultaneously, a report from the Heritage Foundation has called for significant changes to Title IX, arguing the landmark civil rights law has gone too far. This follows a Supreme Court decision regarding transgender participation in school sports. In Washington state, voters will face Initiative IL26-638 this November, which seeks to ban transgender girls from participating in girls’ school sports and would require biological sex verification for female athletes.
