U.S. O-1 Visa Offers Path for International Graduates and Freelancers

The O‑1 visa allows individuals with demonstrated extraordinary ability to work in the United States. It is divided into two categories: O‑1A for achievements in the sciences, education, business or athletics, and O‑1B for the arts, motion‑picture or television industry. For international students on an F‑1 visa, the O‑1 can serve as an alternative to the capped H‑1B program when Optional Practical Training (OPT) expires and a lottery selection is not secured.

Freelancers, consultants, entrepreneurs and other self‑employed professionals are also eligible, provided they can document sustained, high‑level accomplishments across multiple contracts or projects. The petition must be filed by a U.S. employer, a U.S. agent, or, in some cases, a foreign employer acting through a U.S. agent, as the applicant cannot petition on their own behalf.
