Ninth Circuit Court clears path to restore TPS for Venezuelans

The U.S. Court of Appeals for the Ninth Circuit has rejected a petition from the Trump administration to maintain the suspension of Temporary Protected Status (TPS) for hundreds of thousands of Venezuelans. The decision, issued on October 30, denies the government's request to extend the current stay or implement a 21-day administrative pause.

Unless the Supreme Court intervenes, TPS protections and work permits for eligible Venezuelans are expected to be restored on November 6, when the current Supreme Court-authorized suspension expires. The legal battle stems from a decision by former Department of Homeland Security Secretary Kristi Noem, which a lower court ruled exceeded her statutory authority by canceling a previously granted extension for Venezuela.

The National TPS Alliance, representing the plaintiffs, noted that the ruling provides a crucial lifeline for migrants facing deportation. The litigation continues to address the underlying legality of the administration's actions, but the Ninth Circuit's refusal to extend the stay allows the previous favorable ruling to take effect by the November deadline.
