The Senate Health, Education, Labor and Pensions (HELP) Committee voted 13‑9 to advance bipartisan legislation S. 5046, which would prohibit the U.S. Department of Education from transferring four major offices – the Office of Special Education and Rehabilitative Services, the Office of Postsecondary Education, the Office of Elementary and Secondary Education, and the Office of Indian Education – to other federal agencies. The bill is co‑sponsored by Senators Susan Collins (R‑ME), Lisa Murkowski (R‑AK) and Tim Kaine (D‑VA) and now moves to the full Senate for consideration.

The measure targets the Trump administration’s use of interagency agreements to shift tens of billions of education program funds to agencies such as Health and Human Services, Labor and Interior, a strategy the administration says will demonstrate efficiencies and serve as a “proof of concept.” Education Secretary Linda McMahon has defended the agreements, while critics argue that moving programs like the Individuals with Disabilities Education Act – which serves more than 8 million children with disabilities – would undermine their educational focus.

All Democrats on the committee voted for the bill, and Republicans Susan Collins and Lisa Murkowski broke with their party to co‑sponsor it. The legislation represents the strongest congressional pushback yet against the administration’s effort to dismantle the Education Department through interagency transfers.
