Tommy Tuberville introduces bill to overhaul U.S. green card system

Republican Senator Tommy Tuberville of Alabama has introduced the ‘Americans First Immigration Act,’ a bill that proposes a major overhaul of the United States green card system. The legislation seeks to replace the current employment-based visa categories with a points-based system.

Under the proposed law, the annual worldwide allocation for points-based immigrant visas would be set at 192,000. This number could be adjusted based on the number of migrants released from mandatory detention in the previous fiscal year. To qualify, applicants would need a genuine U.S. job offer, be between the ages of 18 and 51, and score at least 16 points. Points would be awarded for factors such as salary, education, English language proficiency, military service, and extraordinary achievements.

The bill could significantly impact Indian professionals currently waiting in long green card backlogs. According to the bill’s text, many existing pending employment-based petitions could be ‘rejected, denied, or invalidated’ once the new system is implemented. Those with already approved petitions would only be able to receive visas until the current fiscal year’s quota for their specific category is exhausted.
