Utah Wins Court Ruling Over Prediction Market Platform Kalshi

U.S. District Judge Robert J. Shelby ruled that Utah’s anti‑gambling statutes apply to the contracts offered by prediction‑market platform Kalshi, granting the state summary judgment in the lawsuit Kalshi filed in February. The judge held that federal commodities law does not preempt Utah’s authority to ban gambling, rejecting Kalshi’s argument that its status as a federally registered derivatives exchange placed its bets outside state regulation.

Utah Attorney General Derek Brown said, “You can’t rebrand illegal gambling as a federal commodity, and today a federal judge agreed with us.” Governor Spencer Cox also praised the decision, stating that gambling is “harmful to countless American families.” The court noted that gambling has traditionally been regulated by the states and that Congress has not overridden that framework. Twenty‑three federally recognized tribes and gaming associations supported Utah’s position. Kalshi announced it will appeal the ruling.

The decision underscores the ongoing debate over whether prediction markets constitute gambling or fall under federal commodity regulation, with potential implications for similar platforms nationwide.
