US State Department lists 44 nations for exchange visitor residency rule

The US State Department has released its Exchange Visitor Skills List by Country, identifying 44 nations whose citizens may be required to return to their home countries for two years after completing an exchange program. This requirement, based on Section 212(e) of the US Immigration and Nationality Act, applies to individuals whose nationality and specific field of expertise are both listed.

Those subject to this two-year home residency rule may face restrictions when attempting to access certain US immigration benefits, such as applying for permanent residency or transitioning to specific work visas. African nations comprise the largest share of the listed countries, including Nigeria, Ghana, Kenya, Ethiopia, Senegal, Togo, Liberia, Rwanda, Tanzania, Zambia, and Mali.

The rule is not a blanket requirement for all citizens of the listed nations; it only takes effect if both the individual's country and their specific area of study or expertise appear on the published list. The State Department advises affected individuals to consult the Federal Register for specific details regarding their country and field.
