U.S. States Tighten Hemp-Derived THC Regulations

Seven Virginia hemp businesses have filed a federal lawsuit challenging the state’s new hemp law that takes effect on Aug. 15. The law eliminates the 25:1 CBD‑to‑THC exemption and limits hemp products to no more than two milligrams of THC per package. Plaintiffs argue the change renders their existing inventory and investments worthless without just compensation, alleging an unconstitutional taking and due‑process violations. The suit seeks a preliminary injunction to block enforcement while the constitutional challenge proceeds.

In Texas, a ban on most hemp‑derived THC products went into effect on Aug. 2, prohibiting the sale and possession of delta‑8, delta‑10, THCA flower and other synthetic THC variants. Only hemp‑derived delta‑9 THC products under 0.3% remain legal. The ban carries felony penalties of up to two years in state jail and fines up to $10,000. Smoke shops such as Bellaire Smoke Shop in Houston report empty shelves and warn that many retailers may not survive the new restrictions.
