U.S. Supreme Court grants extension for YPF litigation appeal

The United States Supreme Court has granted a 30-day extension to the Petersen and Eton Park funds to file a writ of certiorari regarding the YPF expropriation litigation. The decision, overseen by Justice Sonia Sotomayor, moves the original deadline from August 31 to September 30, 2026.

Burford Capital, which finances the plaintiffs, requested the extension citing the heavy workload of the legal team. This appeal represents the final judicial recourse available within the U.S. jurisdiction following a March 2026 ruling by the New York Court of Appeals. That appellate decision overturned a previous lower court judgment by Judge Loretta Preska, which had ordered the Argentine state to pay more than US$ 16 billion.

In addition to the U.S. Supreme Court appeal, the plaintiffs are reportedly preparing a claim through the International Centre for Settlement of Investment Disputes (ICSID), an arbitration tribunal of the World Bank.
