US Terrorist Designation Threatens Brazilian Companies' Operations

The United States is considering classifying Brazil's Primeiro Comando da Capital (PCC) and Comando Vermelho (CV) as foreign terrorist organizations. Under U.S. anti‑terrorism law, the designation would have extraterritorial effect, exposing Brazilian firms with any direct or indirect links to the gangs to criminal investigations, asset freezes, fines and restrictions on accessing international markets.

Compliance experts warn that the greatest risk lies in supply‑chain and logistics arrangements where payments to the groups may occur without a company's knowledge. Companies are urged to reassess their exposure, strengthen due‑diligence controls and review contracts with suppliers and transport providers. Banks and other financial actors could also face sanctions if they process transactions linked to the factions.
