USCIS and State Dept. tighten immigration rules, expand social media vetting
On August 5 2026 the U.S. Citizenship and Immigration Services (USCIS) issued Policy Alert PA‑2026‑05, restoring full discretion for officers to deny immigration benefit requests without first issuing a Request for Evidence (RFE) or a Notice of Intent to Deny (NOID). The change applies to pending and new filings and eliminates the 14‑day international‑mail grace period, limiting response time to three days. Applicants must submit all required initial evidence at filing; missing evidence can lead to an immediate denial.
At the same time the State Department is planning to broaden social‑media vetting of visa applicants. An internal memo obtained by The Daily Signal, and reposted by White House Press Secretary Karoline Leavitt, says applicants will be required to make their social‑media accounts public for screening. The expansion adds foreign journalists and some workers from Mexico and Canada to the list of categories already subject to public‑account checks, such as student visas. The measures are part of the Trump administration’s broader immigration crackdown, which also limits foreign student stays to a maximum of four years and foreign journalist stays to 240 days, with possible extensions.
