USCIS memo does not force green‑card applicants to leave the United States

Immigration lawyers clarified that the memo merely reminds officials of their discretionary authority and does not eliminate the possibility of adjusting status within the United States. Attorney Ava Benach emphasized that existing law and precedent cannot be changed by a memo and urged applicants not to panic. Fellow lawyer Armando Olmedo described the agency’s press release as alarmist, noting the memo lists factors officials may consider but does not compel applicants to travel abroad.

The clarification reassures immigrants that the adjustment‑of‑status process remains available domestically, provided they meet eligibility criteria and officers exercise discretion appropriately.
