USCIS to implement new EB-5 immigrant investor fees
U.S. Citizenship and Immigration Services (USCIS) has finalized a new fee schedule for the EB-5 Immigrant Investor Program, set to take effect on November 30, 2026. Under the new rule, petition fees for standalone investors (Form I-526) and regional center investors (Form I-526E) will more than double, rising from $3,675 to approximately $7,615 and $7,850, respectively.
Additionally, the fee for Form I-829, used to remove conditions on permanent resident status, will increase from $3,750 to $5,000. Integrity Fund fees, designated for fraud investigation and compliance under the EB-5 Reform and Integrity Act of 2022, will also rise by roughly 10% to account for inflation.
Investors should also note that while the regional center program is currently authorized through September 30, 2027, the grandfathering deadline for statutory protection passed on September 30, 2026. Furthermore, the first inflation-based adjustment to minimum investment thresholds—currently $800,000 for targeted areas and $1,050,000 elsewhere—is expected on January 1, 2027.
