USCIS to increase immigration and EB-5 visa fees

The U.S. Citizenship and Immigration Services (USCIS) is implementing significant fee increases for various immigration processes. Starting October 16, 2026, certain initial employment authorization document (EAD) requests for asylum seekers, parolees, and Temporary Protected Status (TPS) beneficiaries will rise by $10, from $560 to $570. Many renewal and extension fees for these categories will remain unchanged.

More substantial increases are scheduled for the EB-5 Immigrant Investor Program, effective November 30, 2026. These adjustments aim to cover administrative costs, meet statutory processing targets, and bolster fraud detection. For standalone investors using Form I-526, fees will increase from $3,675 to $7,615. Investors utilizing regional centers via Form I-526E will see costs rise from $3,675 to $7,850. Additionally, the fee for Form I-829, used to remove conditions on permanent residency, will increase from $3,750 to $5,000.

Furthermore, the EB-5 Integrity Fund fee will rise to $1,100 per investor. While administrative fees are increasing, the baseline investment thresholds for the EB-5 program—currently $800,000 for targeted employment areas and $1.05 million for standard projects—are expected to be adjusted for inflation in January 2027.
