USCIS to update immigration forms for residency and employment

U.S. Citizenship and Immigration Services (USCIS) is updating three key immigration forms in response to a final rule published by the Department of Homeland Security. These changes aim to adjust admission and status adjustment processes, granting officials more discretion in evaluating applicants.

On September 18, a revised edition of Form I-485, used for applying for permanent residence or adjustment of status, will be released. This new version will incorporate updated regulations regarding the ‘public charge’ rule, allowing USCIS to determine if an applicant could potentially become a public charge. USCIS will continue to accept the January 20, 2025, edition if submitted before September 18, but will reject packages using that version if sent on or after that date.

Additionally, new editions of Form I-539 (Application to Extend/Change Nonimmigrant Status) and Form I-765 (Application for Employment Authorization) are scheduled to become effective on September 15, 2026. Applicants are advised to verify the current edition, instructions, and fees on the official USCIS website to avoid application rejections due to using outdated forms.
