Utah enacts law requiring generative AI disclosures

Utah Governor Spencer Cox has signed Senate Bill 226, a law requiring disclosures regarding the use of generative artificial intelligence in consumer transactions and regulated services. Effective May 7, 2025, the law mandates that suppliers must disclose if an individual is interacting with AI rather than a human if prompted by the consumer.

For regulated occupations overseen by the Department of Commerce, providers must proactively disclose AI use during high-risk interactions. These include scenarios involving the collection of sensitive personal, financial, or biometric data, or when providing advice that could impact significant personal decisions, such as legal, medical, or financial services. The Division of Consumer Protection is authorized to impose administrative fines of up to $2,500 per violation.

In a separate discussion regarding AI's impact on the workforce, observers suggest that Utah employers should implement competency-based metrics to ensure AI adoption strengthens employee skills rather than merely automating entry-level tasks. This follows data indicating that AI exposure in certain occupations may widen employment shortfalls for younger workers by automating foundational learning tasks.
