Utah files criminal charges against Kalshi and its co-founders

Utah has filed 14 criminal charges against prediction market operator Kalshi and its co-founders, CEO Tarek Mansour and COO Luana Lopes Lara. The charges include 13 felonies, such as a pattern of unlawful activity and online gambling promotion, and one misdemeanor for general gambling promotion.

The prosecution follows an undercover investigation by the Utah Attorney General’s Office, in which an agent used a local address and debit card to place 12 sports-related wagers on the platform. State officials allege Kalshi continued to accept bets from Utah residents despite a federal court ruling that the state’s anti-gambling laws apply to the company.

This criminal action follows a separate civil lawsuit filed by Utah, which seeks to stop the platform from offering event contracts and aims to recover between $30.5 million and $61.2 million in allegedly unlawful fees.

Kalshi has characterized the charges as a “crazy overreach” and maintains that its event contracts are federally regulated financial derivatives under the Commodity Futures Trading Commission (CFTC). The CFTC has filed its own lawsuit against Utah to block the enforcement of these state laws, arguing it holds exclusive jurisdiction over regulated prediction markets.
