Utah Judge Keeps Death Penalty Option in Charlie Kirk Murder Case

Utah District Court Judge Tony Graf ruled that prosecutor Christopher Ballard violated a pre‑trial publicity order by telling media outlets that the state had “ample evidence” that defendant Tyler Robinson committed the September 10, 2025 killing of conservative activist Charlie Kirk. Graf held Ballard in civil contempt but declined the defense’s request to strip the state of its ability to seek the death penalty, describing such a sanction as “grossly disproportionate” and unavailable under the contempt framework.

Robinson, 23, is charged with aggravated murder, felony firearm discharge, obstruction of justice and other offenses for the shooting at Utah Valley University that killed Kirk, the founder of Turning Point USA. He has not entered a plea. The judge ordered measures to prevent the prosecutor’s comments from prejudicing the jury pool, including expanded juror screening and the possibility of recouping legal‑fee costs. A preliminary hearing is set for July 6, when prosecutors must show sufficient evidence to proceed to trial. DNA was found on the rifle’s trigger, cartridge case and a towel used to wrap the weapon, while ballistics tests on the recovered bullet fragment remain inconclusive.
