Utah judge to consider defense motion to block death penalty in Charlie Kirk killing

Defense attorneys for Tyler Robinson, the 23‑year‑old charged with aggravated murder in the September 10 shooting of conservative activist Charlie Kirk at Utah Valley University, have filed a motion asking Judge Tony Graf to hold prosecutors in contempt for media comments about a bullet fragment recovered from the victim. The attorneys argue the prosecutors violated a gag order by discussing preliminary ballistics findings that have not conclusively linked the fragment to the rifle believed to have been used. They also seek to bar the state from seeking the death penalty, citing a prior case where a contempt sanction was considered.

Prosecutors, represented by Deputy Utah County Attorney Christopher Ballard, contend they were merely correcting misinformation and maintain they will pursue the death penalty if Robinson is convicted. The judge has declined a request to halt proceedings and has not yet ruled on the contempt allegation. A key evidentiary hearing is set for July 6, when prosecutors must demonstrate sufficient proof to move forward to trial.
