Utumishi Girls students denied bail in dormitory fire murder case

A Kenyan High Court judge has denied bail to eight students from Utumishi Girls Academy who are facing murder charges related to a dormitory fire that resulted in the deaths of 16 students. Justice Diana Kavedza-Mochache ruled that releasing the minors could jeopardize their safety and interfere with the judicial process due to high levels of tension, mistrust, and hostility within the school and the surrounding community.

Social inquiry reports presented to the court detailed various disciplinary issues and personal conduct among the accused. These reports included allegations of same-sex relationships at the Nairobi Children's Remand Home and previous school records citing indiscipline, resistance to authority, and declining academic performance. While the students denied allegations of sexual activity, the court reviewed these findings as part of the assessment regarding their environment and potential risks.

The judge emphasized that while the seriousness of the murder allegations is significant, the accused remain entitled to their rights as children, including protection of their welfare, dignity, and access to education and psychological care during the proceedings.
