Madrid court admits lawsuit against Sofía Puente regarding 'Grandchildren Law

A Madrid court has admitted a lawsuit filed by the association Hazte Oír against Sofía Puente, the Secretary General for Innovation and Quality of Public Service in the Ministry of Justice. The lawsuit alleges administrative malfeasance (prevaricación) related to the instructions issued in 2022 regarding the Democratic Memory Law, commonly known as the 'Grandchildren Law'. This instruction facilitated Spanish nationality for descendants of exiles from the Franco era.

Judge Inmaculada Lova Ruiz decided to proceed with the investigation despite opposition from the Madrid Prosecutor's Office, which argued the matter was already settled under the principle of 'res judicata' (cosa juzgada) following a previous dismissal. The investigation may involve testimony from high-ranking officials, including the Ministers of Justice and Foreign Affairs.

Separately, the legal fallout from the law continues as the law firm of Baltasar Garzón has requested the Supreme Court to allow three individuals affected by the suspension of their voting rights—consequent to the law's implementation—to join the ongoing legal proceedings.
