Valencian Court orders 100,000 euro payout for medical negligence case

The High Court of Justice of the Valencian Community (TSJCV) has ordered the regional Health Department to pay 100,000 euros to the family of Marta Pérez. The ruling follows a 2022 incident in Ibi where the 19-year-old suffered irreversible brain damage after consuming a protein shake containing pistachio, an allergen.

The court recognized a failure in medical care and a ‘loss of opportunity’ for improvement. According to the judicial resolution, the medical examination at the Ibi II Integrated Health Center was ‘deficient’ and ‘scant,’ failing to include a thorough physical review or proper documentation of administered medication. While the family sought 4.1 million euros in compensation, the court partially granted the claim, noting that while medical errors occurred, a direct causal link between the assistance received and all current severe sequelae could not be fully established.
