Valencian Court rejects urgent injunction against medical strike minimum services
The High Court of Justice (TSJ) of the Valencian Community has denied an urgent request for interim protection sought by a union against the minimum services established by the Generalitat for an indefinite strike. The strike involves medical staff, doctors, and MIR residents.
The court's Fourth Section of the Contentious-Administrative Chamber ruled that the legal requirements for an immediate, unilateral decision—specifically the appearance of a good right and the danger of procedural delay—were not met. The court noted that because the strike is of an indefinite nature, it does not qualify for the extreme urgency required for such a measure without hearing the administration first.
While the urgent request was dismissed, the proportionality of the minimum services will still be debated in ordinary precautionary proceedings and through appeals against the administrative act.
