Venezuela judicial reform: Experts demand independent TSJ nominations

Legal experts, politicians, and non-governmental organizations in Venezuela are calling for fundamental reforms to the Supreme Tribunal of Justice (TSJ) as part of a broader institutional reconstruction effort.

Constitutional experts and former officials, including Javier Elechiguerra Naranjo and Jesús María Casal, argue that the TSJ nomination committee must be expanded to include civil society, academia, and professional organizations. They emphasize that moving away from a committee dominated by National Assembly deputies is essential to establishing a true rule of law and ensuring judicial independence.

Juan Miguel Matheus, representing the 2015 National Assembly, identified the TSJ reform as a mandatory first step that takes precedence over renewing the National Electoral Council (CNE). The proposed process includes a new round of magistrate nominations and the establishment of an independent Credentials Verification Council to review candidates' technical and ethical suitability.

Simultaneously, various Venezuelan NGOs are demanding an explicit political agreement, subject to international verification, to guarantee judicial impartiality. These organizations are calling for mechanisms to prevent executive and legislative interference, as well as the removal of judicial officials and prosecutors allegedly involved in human rights violations.
