Venezuelan TPS holders seek court order to restore legal status
Attorneys for the National TPS Alliance and Venezuelan Temporary Protected Status (TPS) holders have petitioned a federal appeals court to reinstate a 2025 district court ruling that would restore protection for approximately 600,000 Venezuelans.
The legal challenge follows a Supreme Court stay issued in October 2025, which halted a lower court's decision that the attempt by former Homeland Security Secretary Kristi Noem to strip Venezuelans of TPS violated the Administrative Procedure Act. As the Supreme Court's stay is set to expire in November, the U.S. government is seeking to extend the suspension.
Plaintiffs have submitted declarations detailing the humanitarian impact of the termination, including reports of family separations and deportations to third countries like Liberia. The legal team argues that allowing the current stay to expire without a new one would allow the original district court order to take effect, restoring legal status to the affected population.
