Vietnam banking: Impact of spouse's bad debt on loan eligibility
A spouse's bad debt does not automatically prevent their partner from obtaining a bank loan. According to credit information regulations in Vietnam, credit history is collected and stored for each individual borrower based on their specific identification.
When a husband applies for a loan, banks primarily evaluate his own credit history, repayment capacity, and the legality of the loan purpose. However, a spouse's bad debt may still influence the appraisal process in specific scenarios. This includes cases where the loan is intended for common family needs, the spouse is a co-borrower, or the spouse's income is used as a source for debt repayment.
Legal frameworks, including Circular No. 15/2023/TT-NHNN and the Law on Marriage and Family 2014, distinguish between individual debts and common marital obligations. Banks will assess whether the borrower meets the necessary financial conditions and provides a feasible plan for capital use.
