Vietnam Construction Law clarifies notice requirements for individual houses
The Ministry of Construction has addressed inquiries regarding whether individual households and individuals must submit construction commencement notices for private residential projects under the 2025 Construction Law.
The clarification follows a case in Hanoi where a citizen was penalized by local authorities for failing to provide a commencement notice. The individual cited Clause 3, Article 43 of the 2025 Construction Law, which specifies that certain projects—including individual houses for households and individuals—are exempt from the requirement to send a construction commencement notice to local state management agencies.
The Ministry's response aims to ensure consistent legal application, noting that while certain projects require notification, individual residential constructions are explicitly listed among the exceptions to this obligation.
