Vietnam implements new land management penalty regulations
Vietnam has implemented Decree 281/2026/NĐ-CP, effective August 31, 2026, which introduces significant changes to administrative penalties in the land management sector. The decree amends the previous Decree 123/2024/NĐ-CP to decentralize enforcement and increase penalty capacities.
A major shift includes the expansion of authority for commune-level People's Committee Chairpersons, who can now issue fines of up to 250 million VND for individuals and 500 million VND for organizations. This represents a substantial increase from previous limits. Additionally, the decree abolishes the penalty authority of District-level People's Committee Chairpersons to facilitate faster local enforcement.
For investors, the decree removes the 2 to 3 million VND fine for delayed land fluctuation registration when land is acquired through civil agreements for investment projects. Other officials, such as Directors of Departments of Agriculture and Environment, are now authorized to issue fines up to 400 million VND, and the People's Public Security forces have gained expanded powers to address serious violations like land encroachment and document forgery.
