Vietnam tightens real estate and land management regulations

Vietnam has implemented Decree 339/2026/ND-CP, introducing stricter administrative penalties for violations in the construction, housing management, and real estate sectors. Effective August 26, 2026, the decree imposes significant fines on real estate brokers operating without professional certificates, with penalties reaching 60 million VND for individuals and up to 160 million VND for organizations failing to establish proper business entities or providing dishonest information.

In the housing sector, condominium management boards face fines of up to 60 million VND for the misuse of maintenance funds or unauthorized changes to common property usage. Additionally, real estate trading floors may be fined up to 600 million VND for offering properties that do not meet legal business requirements.

Recent enforcement actions include a 170 million VND fine against Hoa Binh Cooperative in Hanoi for occupying state land and dumping waste, and a penalty against Son Kim Real Estate JSC in Ho Chi Minh City for failing to report sales of units to foreign individuals and organizations to the Department of Construction. Meanwhile, the Ministry of Natural Resources and Environment has issued directives to prevent favoritism toward unauthorized intermediaries in land administrative procedures, demanding transparency and accountability in processing land-related dossiers.
