Vietnam issues new decree on foreign recruitment of local workers
The Vietnamese government has issued Decree No. 371/2026/ND-CP, establishing new regulations for foreign organizations and individuals recruiting Vietnamese workers within the country. The decree, signed by Deputy Prime Minister Pham Thi Thanh Tra, is set to take effect on November 15, 2026.
Under the new rules, foreign entities must provide written notification to competent management authorities regarding job positions and the number of employees required. Recruitment information must be publicly disclosed on the National Job Exchange (vieclam.gov.vn), other legal employment portals, or the organization's official website.
Regarding post-recruitment management, foreign employers are required to notify management authorities within 10 working days of signing a labor contract. This notification must include the employee's full name, personal identification number, job position, and start date. Additionally, employers must report contract terminations to the authorities within 10 working days, specifying the reason for the termination.
